Limits of Supranational Justice:The European Court of Human Rights and Turkey's Kurdish Conflict
90折
作者:Dilek Kurban  出版社:Cambridge Univ Pr  出版日:2022/08/11 裝訂:平裝
With its contextualized analysis of the European Court of Human Rights' (ECtHR) engagement in Turkey's Kurdish conflict since the early 1990s, Limits of Supranational Justice makes a much-needed contribution to scholarships on supranational courts and legal mobilization. Based on a socio-legal account of the efforts of Kurdish lawyers in mobilizing the ECtHR on behalf of abducted, executed, tortured and displaced civilians under emergency rule, and a doctrinal legal analysis of the ECtHR's jurisprudence in these cases, this book powerfully demonstrates the Strasbourg court's failure to end gross violations in the Kurdish region. It brings together legal, political, sociological and historical narratives, and highlights the factors enabling the perpetuation of state violence and political repression against the Kurds. The effectiveness of supranational courts can best be assessed in hard cases such as Turkey, and this book demonstrates the need for a reappraisal of current academic and

Individual Rights and the Making of the International System
90折
作者:Christian Reus-Smit  出版社:Cambridge Univ Pr  出版日:2013/09/30 裝訂:平裝
We live today in the first global system of sovereign states in history, encompassing all of the world's polities, peoples, religions and civilizations. Christian Reus-Smit presents a new account of how this system came to be, one in which struggles for individual rights play a central role. The international system expanded from its original European core in five great waves, each involving the fragmentation of one or more empires into a host of successor sovereign states. In the most important, associated with the Westphalian settlement, the independence of Latin America, and post-1945 decolonization, the mobilization of new ideas about individual rights challenged imperial legitimacy, and when empires failed to recognize these new rights, subject peoples sought sovereign independence. Combining theoretical innovation with detailed historical case studies, this book advances a new understanding of human rights and world politics, with individual rights deeply implicated in the making

The rise of neoliberal policy and practice simultaneous to the growing recognition of economic and social rights presents a puzzle. Can the rights to food, water, health education, decent work, social security and the benefits of science prevail against market fundamentalism? Economic and Social Rights in a Neoliberal World is about the potential of these rights to contest the adverse impacts of neoliberal policy and practice on human wellbeing. Cutting across several lines of human rights literature, the chapters address norm development, court decision making, policymaking, advocacy, measurement and social mobilization. The analyses reveal that neoliberalism infiltrates management practices, changes international policy goals, flattens public school curriculum and distorts the outputs of UN human rights treaty bodies. Are economic and social rights successful in challenging neoliberalism, are they simply marginalized or are they co-opted and incorporated into neoliberal frameworks? T

作者:Mark E. Neely; Jr  出版社:Cambridge Univ Pr  出版日:2017/01/31 裝訂:精裝
Lincoln and the Democrats describes the vexatious behavior of a two-party system in war and points to the sound parts of the American system which proved to be the country's salvation: local civic pride, and quiet nonpartisanship in mobilization and funding for the war, for example. While revealing that the role of a noxious 'white supremacy' in American politics of the period has been exaggerated - as has the power of the Copperheads - Neely revives the claim that the Civil War put the country on the road to 'human rights', and also uncovers a previously unnoticed tendency toward deceptive and impractical grandstanding on the Constitution during war in the United States.

For well over a century, humanitarians and their organizations have used photographic imagery and the latest media technologies to raise public awareness and funds to alleviate human suffering. This volume examines the historical evolution of what we today call 'humanitarian photography' - the mobilization of photography in the service of humanitarian initiatives across state boundaries - and asks how we can account for the shift from the fitful and debated use of photography for humanitarian purposes in the late nineteenth century to our current situation in which photographers market themselves as 'humanitarian photographers'. This book investigates how humanitarian photography emerged and how it operated in diverse political, institutional, and social contexts, bringing together more than a dozen scholars working on the history of humanitarianism, international organizations and nongovernmental organizations, and visual culture in Africa, Asia, the Middle East, Europe, and the Unite
