This is a reference manual providing guidance to lawyers representing clients in the federal appellate courts of the United States. It begins with an overview of the appellate court's role in the federal judiciary and a discussion of professionalism and ethics in appellate advocacy. It then discusses pre-brief issues such as preserving issues for appeal, jurisdiction, standard of review, preliminary filings, and settlement of cases on appeal. The next set of chapters focus on the appellate brief itself, discussing record on appeal and the joint appendix, writing the appellate brief, the introduction and statement of the issues, substantive statements and summary of arguments, and other requirements of an appellate brief. Remaining chapters cover interjurisdictional certification; oral argument; post-brief, post-argument, and post-decision filings; significant variations among the circuit courts in terms of jurisdiction, local rules, and publication of decisions; and appeals from administrative agency decisions.
