Letting and hiring was one of four kinds of consensual contracts that Roman law scholars of the first three centuries in the current era examined in great detail. During the 20th century, legal scholars have viewed them in the context of codified law maintained by and for elite jurists, and ancient historians have viewed them within the context of social interactions of commerce and trade, says Plessis (law, U. of Edinburgh), but until now no one has combined the two approaches. He considers in turn the letting and hiring of work (operae) and the letting and hiring of an object (res). Quotations are in Latin followed by English translation. 作者簡介
Paul J. du Plessis, Ph.D. (2003) in Law, Erasmus University Rotterdam, is Senior Lecturer in Law at the University of Edinburgh. He has published extensively on Roman law.
