The International Court of Justice in 1996 delivered an advisory opinion on the legality of nuclear weapons that stated while international law does not specifically prohibit their use, important environmental factors should be taken into account. Koppe, a Dutch attorney and former research assistant, examines the court's opinion and focuses on whether or not the use of nuclear weapons during armed conflict violate existing international law as it relates to protecting the environment. In Part I, the author examines the development and effects of nuclear weapons; in Part II, he discusses legal interpretations of law regarding environmental protection during conflict. Erik V Koppe is a solicitor at Freshfields Bruckhaus Deringer and former research assistant in the Department of International Law at the University of Groningen, the Netherlands.
