As World War II drew to a close and the world awakened to the horror wrought by white supremacists in Nazi Germany, African American leaders, led by the NAACP (National Association for the Advancement of Colored People), sensed the opportunity to launch an offensive against the conditions of segregation and inequality in America. The 'prize' they sought was not civil rights, but human rights. Only the human rights lexicon, shaped by the Holocaust and articulated by the United Nations, contained the language and the moral power to address not only the political and legal inequality but also the education, health care, housing, and employment needs that haunted the black community. But the onset of the Cold War and rising anti-communism allowed powerful Southerners to cast those rights as Soviet-inspired. Thus the Civil Rights Movement was launched with neither the language nor the mission it needed to truly achieve black equality.
This book traverses three pivotal human rights struggles of the post-September 11th era: the American human rights campaign to challenge the Bush administration's 'War on Terror' torture and detention policies, Middle Eastern efforts to challenge American human rights practices (reversing the traditional West to East flow of human rights mobilizations and discourses) and Middle Eastern attempts to challenge their own leaders' human rights violations in light of American interventions. This book presents snapshots of human rights being appropriated, promoted, claimed, reclaimed and contested within and between the American and Middle Eastern contexts. The inquiry has three facets: first, it explores intersections between human rights norms and power as they unfold in the era. Second, it lays out the layers of the era's American and Middle Eastern encounter on the human rights plane. Finally, it draws out the era's key lessons for moving the human rights project forward.

Having articulated numerous human rights norms and standards in international treaties, the pressing challenge today is their realisation in States' parties around the world. Domestic implementation has proven a difficult task for national authorities as well as international supervisory bodies. This book examines the traditional State-centric and legalistic approach to implementation, critiquing its limited efficacy in practice and failure to connect with local cultures. The book therefore explores the permissibility of other measures of implementation, and advocates more culturally sensitive approaches involving social institutions.
