Antidumping

This work examines the role of antidumping laws in broader programs of trade liberalization in developing countries. It particularly focuses on the role of antidumping as a temporary measure to protect fledgling industries, the viability of competition law as a replacement for antidumping, and ways of improving the application of antidumping rules given the ambiguity of the current World Trade Organization Antidumping Agreement. The author describes the basic definitional issues of dumping and antidumping, reviews the current WTO antidumping law, compares the antidumping experiences of Egypt and India in the iron and steel sector, assesses the impact of price discrimination law and predatory pricing law in the United States and the European Union in order to compare the efficacy of competition law versus antidumping law, and discusses the issue of economies of scale as barriers to effective competition and its meaning for the antidumping versus competition law debate.
