International Arbitral Jurisdiction

This volume is intended as a companion to two earlier publications by the author: Jurisdiction of International Tribunals (2003) and Jurisdiction of Specific International Tribunals (2009). The objective here is to elucidate principles pertaining to international arbitral tribunals and, in particular, to discuss the Iran-US Claims Tribunal, which has evolved a distinctive character. Amerasinghe (law, U. of Ceylon, Colombo) is a member of the Institute de Droit International and a former judge and UN administrative tribunal. His presentation begins with a history of arbitration and discussion of the personality of arbitral tribunals, the place of precedent, and how work gets done. Following are eight chapters on "generalities," including consent as the basis of jurisdiction, the matter of competence, and inadmissibility, among other topics.
