Sex and the Contract

Dealing with criminal activities associated with sex for sale is familiar territory for the law, but fitting the biological/emotional/ cultural aspects of sexual transactions including prostitution, pornography, online dating, and sexual tourism into contract law is more ambiguous and less explored in the legal literature. In a cogent novel approach, Zeno-Zencovich (comparative law, Roma Tre U., Italy) compares market and non-market sex in terms of consumer and property rights, sexual and intellectual freedom, sex work as a profession, and immorality vs. illegal contracts. He contrasts European perspectives whose views of paid sexual services range from regarding it as an integral aspect of life to exploitation of women (e.g., per Sweden's feminist absolutionist-influenced ban).
