When Justice Meets Politics ― Independence and Autonomy of Ad Hoc International Criminal Tribunals

Bachmann (political science, U. of Social Sciences and Humanities, Poland), Sparrow-Botero (a journalist with the BBC in the United States), and Lambertz (a doctoral candidate at the U. of Leipzig, Germany) seek to determine the autonomy of international criminal tribunals, approaching the question from an institutional perspective that moves the analysis beyond simple questions of bias and impartiality towards a consideration of when the prosecutor (as the agenda setter of international criminal tribunals) acts as an independent agent on the international stage. They first consider where and when European Union policy was changed towards Croatia and Serbia's obligation to comply with the International Criminal Tribunal on the former Yugoslavia (ICTY) through the application or withdrawal of different conditions for EU accession and then seek to determine the agential source for such changes. Klaus Bachmann is a professor of political science at the University of Social Sciences and Humanities in Warsaw. He was an observer at the ICTY during the trials of Biljana Plav?ic and Slobodan Milo?evic.
Thomas Sparrow-Botero is a journalist and translator. He currently works for the BBC in the United States. Previously, he reported on Central and Eastern European topics for Latin American media outlets. He covered, among other events, the judgement of Ante Gotovina and the capture of Ratko Mladic.
Peter Lambertz is a PhD candidate at the University of Leipzig. He holds a Licence en Histoire from the Universite Libre de Bruxelles and an MA in Global Studies from the universities of Leipzig and Wroclaw.
